Does Delta 9 Ship to California in 2026? What's Legal and Where to Buy
If you live in California and you have been ordering hemp delta 9 gummies or vapes online, the rules changed on you. California spent 2024 and 2025 tightening its hemp laws, and the biggest change took effect on January 1, 2026.
The short version: hemp-derived THC products are no longer a legal retail or online category in California. THC still has a legal home in the state, but it runs through licensed cannabis dispensaries rather than hemp e-commerce. Here is what changed, what can still ship to a California address, and what your options actually are.
1. The Short Answer
No, not the way it worked before 2026. Assembly Bill 8 took effect January 1, 2026 and pushed intoxicating hemp products out of California's general retail and online channels. Hemp foods, drinks and supplements sold in California are now limited to CBD or CBN isolate at greater than 99% purity with no THC at all.
California did not take THC away from adults. It moved all of it into the licensed cannabis system, where the state tests it, taxes it, and tracks it. For a Californian who wants THC gummies or vapes, a licensed dispensary is the route that holds up.
2. What AB 8 Changed on January 1, 2026
AB 8 made permanent the emergency rules California issued in September 2024 and went further. The provisions that matter most to an online buyer:
- Total THC, not just delta 9. Products are measured against a 0.3% total THC standard on a dry weight basis, which counts THCA and other THC forms.
- Synthetic and converted cannabinoids are out. Delta 8, delta 10, and other cannabinoids made by chemically converting CBD are prohibited outside the licensed cannabis system. Most commercial delta 8 is made this way.
- Inhalable hemp THC is out. Hemp flower, pre-rolls, and inhalable products containing hemp-derived THC are prohibited.
- Hemp foods, drinks and supplements are isolate only. CBD or CBN isolate above 99% purity, with no THC and no synthetic cannabinoids.
- The tax gap closed. California's 15% cannabis excise tax now reaches hemp products too, so the old price advantage over dispensary purchases is gone.
Implementation is phased through January 1, 2028, with direct-to-consumer hemp e-commerce facing full compliance requirements by that date. Violations can be charged as misdemeanors, not just fined.
3. SB 378 and Why Retailers Block California at Checkout
Senate Bill 378 took effect July 1, 2026. It puts civil liability, including treble damages, on online marketplaces that facilitate intoxicating hemp sales into California.
That is why you will increasingly see California blocked at checkout on hemp THC sites, or an order canceled after the fact. A retailer that geo-blocks California is not being difficult. It is responding to a law written specifically to make shipping into the state expensive.
If a site happily ships you a 25mg delta 9 gummy in California today, that tells you something about how closely it follows state law, which is worth knowing before you hand over a card number.
4. What Can Still Ship to a California Address
Two categories are unaffected by California's THC rules:
CBD and CBN products with no THC
Isolate-based CBD and CBN products are the hemp category California still allows. Check the lab report and confirm THC is listed as non-detect, not simply "within federal limits." The 420 King's CBD range and CBD edibles each publish a lab report on the product page.
Functional mushroom products
Functional mushroom gummies made with lion's mane, reishi, cordyceps and chaga contain no cannabinoids, so California's hemp THC rules do not apply to them. These are not psilocybin products, which remain illegal. Browse the functional mushroom range or read our mushroom gummy buyer's guide for what to check on a label.
5. Where Californians Can Legally Buy THC
California legalized recreational cannabis through Proposition 64 in 2016. Adults 21 and over can buy from retailers licensed by the Department of Cannabis Control, and licensed delivery operates across much of the state.
What you get through that channel: higher-potency products than hemp rules ever allowed, mandatory state testing, and clear legal footing. What you pay for it: the 15% state cannabis excise tax plus local cannabis taxes, which in some cities push the total well above 30%.
The hemp vs dispensary THC guide covers how the two systems differ in testing, potency and price.
6. How to Check Before You Order
- Read the lab report, not the marketing. For California, you want non-detect THC on a CBD or CBN product, or a product with no cannabinoids at all.
- Treat delta 8, delta 10, THCP and converted cannabinoids as off the table. AB 8 names these directly.
- Skip hemp flower, pre-rolls and hemp THC vapes. Inhalable hemp THC is prohibited regardless of potency.
- Check the retailer's shipping policy first. The 420 King publishes its restricted states on the delivery page, and orders we can not ship are canceled and refunded rather than sent.
- Be 21 or older. Age verification applies to every order.
7. The Federal Change Coming December 11, 2026
California is ahead of the federal government here, not behind it. A law signed in November 2025 rewrote the federal definition of hemp around total THC and capped finished products at 0.4mg of total THC per container. H.R. 6500, signed in September 2026, pushed most of those provisions to December 11, 2026, while restrictions on cannabinoids that the cannabis plant can not naturally produce still begin November 12, 2026.
When that lands, the hemp THC products California already restricts will be non-compliant federally as well. Bills to delay or replace the federal provisions are pending in Congress but had not cleared committee as of early September 2026. Our 50-state delta 9 guide tracks where every state sits.
Frequently Asked Questions
Can you ship hemp delta 9 gummies to California in 2026?
Not under current state law. AB 8, effective January 1, 2026, limits hemp foods, drinks and supplements sold in California to CBD or CBN isolate with no THC. Higher-potency THC products are sold through licensed cannabis dispensaries instead.
Is delta 8 legal in California?
No. AB 8 prohibits synthetic and chemically converted cannabinoids, which covers the acid-converted delta 8 that makes up nearly all of the commercial market.
Can I order hemp flower or pre-rolls to California?
No. AB 8 prohibits inhalable products containing hemp-derived THC, including hemp flower and pre-rolls.
Why do some websites still ship hemp THC to California?
Because enforcement takes time, not because it is allowed. SB 378, effective July 1, 2026, created civil liability with treble damages for online marketplaces facilitating intoxicating hemp sales into California, which is why compliant retailers block the state.
What can I legally order online in California?
CBD and CBN products with non-detect THC, and functional mushroom products such as lion's mane, reishi and cordyceps. Both ship without running into California's THC rules.
Do I need a medical card to buy cannabis in California?
No. Proposition 64 legalized adult use in 2016. Anyone 21 or over can buy from a licensed dispensary with a valid ID, and licensed delivery is widely available.
The Bottom Line
California closed the hemp THC lane in 2026. Hemp delta 9 gummies, delta 8, and hemp flower are not legal retail categories in the state any more, and the federal definition catches up in December. For THC, a licensed California dispensary is the route that holds up. For something you can order online, CBD with non-detect THC and functional mushroom products are the categories that are unaffected.
