Does Delta 9 Ship to Texas in 2026? What's Legal After the New Law
Texas changed its hemp rules in 2026, and the change was not minor. If you are in Texas and trying to work out what you can still order, you need two separate answers: what Texas law now allows, and what online retailers will actually ship to a Texas address. They are not the same thing.
Here is the straight version, including why The 420 King does not ship THC products to Texas at all right now.
1. The Short Answer
Under Texas law, hemp-derived delta 9 products that stay at or below 0.3% delta 9 THC by dry weight, such as edibles, drinks and tinctures, remain legal for adults 21 and over.
But delta 8, delta 10, THCP and THCA flower became Schedule I controlled substances in Texas on July 31, 2026. Possession is a state jail felony.
And The 420 King does not ship THC products to Texas. Texas is on our restricted list, so a THC order to a Texas address is canceled and refunded rather than shipped. Plenty of sites will still take that order. That is their risk calculation, and it becomes your problem at the delivery stage.
2. What Changed on July 31, 2026
In May 2026, the Texas Supreme Court cleared the way for the state to enforce a Department of State Health Services rule written back in 2021. That rule classifies synthetically derived THC as a Schedule I controlled substance. A temporary injunction had blocked it for years while hemp businesses, led by Austin-based Hometown Hero, fought it in court. When that injunction fell, DSHS reinstated the old definitions effective July 31, 2026.
What that covers, according to reporting by the Texas Tribune:
- Delta 8 THC
- Delta 10 THC
- THCP
- THCA flower
All of it is now treated as Schedule I in Texas, which prohibits possession and sale.
The penalties are real
Possession of these products in Texas is a state jail felony carrying 180 days to two years of confinement and a fine of up to $10,000. Businesses that sell them can lose their consumable hemp licenses, face fines of up to $10,000 per violation, and face criminal charges for distributing a Schedule I substance.
Litigation continues. A federal judge rejected an emergency motion against the ban in August 2026. Treat the ban as in force.
3. What Is Still Legal in Texas
The exception is natural hemp-derived delta 9. Products at or below 0.3% delta 9 THC by dry weight remain legal in Texas, which covers:
- Delta 9 edibles, including gummies
- Delta 9 drinks
- Tinctures
Smokable delta 9 hemp also remains available because a court ruling paused a statewide smokable hemp ban that had been set for March 31. THC vape pens were separately restricted in the previous legislative session.
Buyers must be 21 or over. CBD and functional mushroom products are not affected by any of the THC rules above.
4. Why "Federal Law Preempts Texas" Is Not a Defense
You will see hemp sites argue that because the 2018 Farm Bill made hemp federally legal, state rules do not apply to interstate shipments. That argument does not hold up, and it is not a defense if a package is intercepted or you are stopped with the product.
The Farm Bill legalized hemp federally and protects the interstate transport of compliant hemp. It does not stop a state from prohibiting an intoxicating cannabinoid inside its own borders, and many states have done exactly that. Texas is one of them. A delta 8 gummy shipped from a state where it is legal is still a Schedule I substance once it reaches a Texas address.
Any retailer telling you otherwise is managing its own risk, not yours.
5. What The 420 King Ships to Texas
We do not ship THC products to Texas. The delivery page carries the current restricted list, which also includes Alabama, Alaska, Colorado, Connecticut, Hawaii, Idaho, Minnesota, North Dakota, Oregon, Rhode Island, Utah, Vermont and Washington. Orders to those states are canceled and refunded.
What Texans can still order from us:
- CBD products, including gummies, tinctures and topicals.
- Functional mushroom products, which contain no cannabinoids at all.
A retailer that blocks your state is not being unhelpful. It is the clearest signal you will get that it reads the law the same way the state does.
6. If You Already Have Products in Texas
This is not legal advice, and a Texas attorney is the right person to ask about your specific situation. In general terms: the products now on Texas's Schedule I list are delta 8, delta 10, THCP and THCA flower. Possession carries felony exposure. Do not carry them across state lines into Texas, and do not assume a lab report showing federal compliance resolves a state Schedule I question.
7. The Federal Change Coming December 11, 2026
A separate federal change is close behind. A law signed in November 2025 redefines hemp around total THC and caps finished hemp products at 0.4mg of total THC per container. H.R. 6500, signed in September 2026, moved most of those provisions to December 11, 2026, while restrictions on cannabinoids the cannabis plant cannot naturally produce start November 12, 2026.
For Texans, that means the delta 9 edibles still legal under state law face a federal limit at the end of the year unless Congress acts. Our 50-state delta 9 guide covers the pending bills.
Frequently Asked Questions
Does delta 9 ship to Texas in 2026?
Not from The 420 King. Texas is on our restricted list and THC orders to Texas addresses are canceled and refunded. Under Texas law, hemp delta 9 edibles and drinks at or below 0.3% by dry weight remain legal for adults 21 and over, but delta 8, delta 10, THCP and THCA flower are Schedule I.
Is delta 8 legal in Texas?
No. Delta 8 became a Schedule I controlled substance in Texas on July 31, 2026, along with delta 10, THCP and THCA flower. Possession is a state jail felony carrying 180 days to two years and a fine of up to $10,000.
What made Texas able to enforce the ban?
A Texas Supreme Court ruling in May 2026 lifted a 2021 injunction that had blocked a Department of State Health Services rule classifying synthetically derived THC as Schedule I. DSHS reinstated those definitions effective July 31, 2026.
Is THCA flower still legal in Texas?
No. THCA flower is named in the ban and is treated as Schedule I in Texas as of July 31, 2026.
Can I still buy CBD in Texas?
Yes. CBD products and functional mushroom products are not covered by the THC restrictions, and we ship both to Texas.
Why do other websites still ship delta 8 to Texas?
Because enforcement takes time and some retailers accept the risk. The legal status of the product does not change based on who shipped it. In Texas, possession of these products carries felony exposure regardless of where the package came from.
The Bottom Line
Texas now sits among the most restrictive states for hemp cannabinoids. Natural delta 9 edibles and drinks remain legal there for adults 21 and over, but delta 8, delta 10, THCP and THCA flower are Schedule I with felony exposure, and we do not ship THC products into the state.
If you are in Texas, CBD and functional mushroom products are what we can get to you, and the delivery page is the authoritative list of where we ship.
