Are Hemp THC Products Legal in My State? 2026 Guide by State

One of the first questions people ask before ordering hemp THC online is simple: is it legal where I live? For most of the country the answer is yes, today. But federal law is about to change, state rules vary, and "legal in my state" is not the same as "a retailer will ship it to me."

This guide explains how federal and state hemp law fit together in 2026, which states we cannot ship THC to, which product types face the most state restrictions, and how to check before you order. It reflects the law as of October 2026.

1. The Federal Foundation: The 2018 Farm Bill

The 2018 Farm Bill removed hemp from the federal Controlled Substances Act. Hemp is cannabis with no more than 0.3% delta 9 THC by dry weight. Products that meet that limit, including hemp-derived delta 9 gummies, vapes and THCA flower, are federally legal to make, sell and ship across state lines.

Because the rule is measured by weight, a 5 gram gummy can hold up to 15mg of delta 9 and still be compliant. That is why hemp-derived delta 9 gummies became so popular.

What federal law never did is stop states from adding their own rules. Federal legality is a floor, not a guarantee in every state.

2. The Big Change Coming on December 11, 2026

In November 2025, Congress rewrote the federal hemp definition (Section 781 of Public Law 119-37). After a delay passed in September 2026, the main changes take effect on December 11, 2026:

  • Total THC, not just delta 9: THCA now counts toward the 0.3% limit, which removes most THCA flower from the hemp definition.
  • A 0.4mg total THC per container cap on finished consumer products, which captures nearly every delta 9 gummy, vape and drink sold today.
  • Converted cannabinoids such as delta 8 made from CBD are excluded from hemp.

Fully synthetic cannabinoids lose hemp status earlier, on November 12, 2026. Bills to replace the ban with regulation are pending, but none has passed. Our 2026 federal hemp law explainer covers every detail.

3. States We Cannot Ship THC To

The quickest way to answer "can I order THC from The420King?" is our shipping list. We are currently unable to ship THC products to:

Alabama, Alaska, Colorado, Connecticut, Hawaii, Idaho, Minnesota, North Dakota, Oregon, Rhode Island, Texas, Utah, Vermont and Washington.

Some of these states ban hemp THC outright, some restrict specific cannabinoids or product types, and some regulate hemp THC through their own licensing systems. Either way, we do not ship THC there. Our smoke shop accessories and non-THC products, such as Santa Cruz grinders, are not affected by this list. The current list always lives on our delivery page.

If you live in Texas, our Texas guide explains the July 2026 change in detail.

4. States That Restrict Specific Cannabinoids

Even where hemp THC is allowed, many states single out particular cannabinoids. Delta 8 is the most common target, and several states that allow hemp delta 9 ban or limit delta 8, delta 10 and THCP. A few states, California among them, ban inhalable hemp THC products entirely while still allowing some edibles.

These rules change often. If you are shopping for anything beyond standard hemp delta 9, check your state's current law before ordering. Your state's Department of Agriculture or health department is the authoritative source.

5. Smokable Hemp: Flower and Pre-Rolls

Flower and pre-rolls face more state restrictions than edibles. Smokable hemp looks and smells like marijuana, which makes enforcement harder in states where marijuana is illegal, and several states have restricted smokable hemp or THCA flower for that reason.

The federal total-THC test on December 11, 2026 also hits THCA flower and pre-rolls hardest. If smokable hemp is your format, read our THCA flower guide before you stock up.

6. Gummies and Edibles: The Most Widely Accepted Format

Under current rules, hemp-derived delta 9 gummies are the format accepted in the most states. They carry no visual similarity to marijuana and their dose is easy to label and verify. If you want one product that works in as many places as possible today, a compliant delta 9 gummy is usually it.

Browse delta 9 gummies or the wider edibles collection. For flower and pre-rolls in states we ship to, Mood Cannabis is one of our most popular brands.

7. What About Mushroom Products?

Mushroom products are a separate legal question from hemp THC. Functional mushroom products such as Polkadot and Tre House chocolate bars and gummies contain no psilocybin and are not covered by hemp law. Psilocybin remains federally illegal. Our mushroom gummy legality guide covers the state-by-state picture.

8. Age Requirements Everywhere

Whatever your state's hemp rules, you must be 21 or older to buy hemp THC products. We verify age at checkout through an automated age verification service, the same kind of check used by online alcohol and tobacco sellers.

9. How to Check Before You Order

  1. Check our delivery page to confirm we ship THC to your state.
  2. Check your state's rules for the specific product type: flower, vape, edible or delta 8.
  3. Open the product's lab report and confirm the cannabinoid content. Our COA guide shows what to look for.
  4. Keep the December 11, 2026 federal date in mind when planning larger orders.

Hemp law is not static. States pass new rules every year, and the federal rules are still in motion. Advocacy groups such as the U.S. Hemp Roundtable track state changes if you want to follow along.

Frequently Asked Questions

Can I order delta 9 gummies online and have them shipped to my house?
In most states, yes, as long as the products meet the 2018 Farm Bill limits and your state allows them. We cannot ship THC to Alabama, Alaska, Colorado, Connecticut, Hawaii, Idaho, Minnesota, North Dakota, Oregon, Rhode Island, Texas, Utah, Vermont or Washington.

Are hemp THC products the same as marijuana products?
The delta 9 molecule is identical. The difference is the source plant and the legal framework: hemp must stay under 0.3% delta 9 by dry weight and is regulated federally, while marijuana is regulated by each state. Our hemp vs marijuana delta 9 guide explains more.

Do I need a medical card to buy hemp THC online?
No. You only need to be 21 or older and live in a state where the product is allowed and we ship.

What if my state law is stricter than federal law?
State law applies. Federal legality does not protect you inside a state that has banned a product, so check your state's rules before ordering.

Will hemp THC products still be legal after December 11, 2026?
Most current hemp THC products would no longer meet the federal hemp definition from that date unless Congress changes the law first. Non-intoxicating CBD products that stay under the new limits are not the target.

Can I fly with hemp THC products?
We do not recommend it. Rules differ between your departure and arrival states, and airport security can refer suspected THC to local police.

The Bottom Line

For most Americans, hemp-derived THC is legal to order online right now, with exceptions in the states listed above and stricter rules for some cannabinoids and smokable products. The bigger change is the federal rewrite on December 11, 2026. Check our delivery page, read the lab report, and order from a retailer that tells you plainly where it ships.
